Privacy Policy of the Unsaid Application

Effective Date: June 3, 2025

Even Labs, an individual registered in Ukraine (hereinafter – "Developer"), respects the privacy of users of the mobile application "Unsaid" (hereinafter – "Application") and is committed to protecting their personal data. This Privacy Policy (hereinafter – "Policy") governs the collection, use, storage, and protection of personal data in accordance with the Law of Ukraine "On Personal Data Protection," the General Data Protection Regulation (GDPR) for users in the European Union, the California Consumer Privacy Act (CCPA), and other applicable regulations.

Using the Application constitutes your consent to the terms of this Policy. If you do not agree with the Policy, please discontinue use of the Application.

1. Collection of Personal Data

The Developer collects the following categories of personal data:

  • Registration Data: Email address, Apple ID, or Google account provided during registration.
  • Technical Data: IP address, device fingerprint, and geolocation data (when necessary for providing services).
  • Activity Data: Information about user actions within the Application, including posting and viewing content.
  • Violation Data: History of violations, account suspension status, and email address for moderation purposes.

No other data, such as name or age, is collected. Payment data is processed solely by payment systems (Apple Pay, Google Pay) without access by the Developer.

2. Purposes of Data Processing

Personal data is processed for the following purposes:

  • Ensuring the functionality of the Application, including registration and access to features.
  • Moderating content and ensuring the security of the Application.
  • Analyzing user activity to improve functionality and user experience.
  • Personalizing content based on user preferences.
  • Complying with legal obligations.

3. Legal Basis for Processing

Data processing is based on the following grounds:

  • User consent provided during registration.
  • Performance of the User Agreement.
  • Legitimate interests of the Developer (e.g., improving the Application, ensuring security), provided this does not infringe user rights.
  • Compliance with Ukrainian law, GDPR, CCPA, or other applicable regulations.

4. Sharing Data with Third Parties

Personal data is not shared with third parties, except in the following cases:

  • Mixpanel: An analytics service used to analyze user activity, solely for the Developer's purposes. Users may opt out of analytics through the Application's settings.
  • Payment Systems: Payment processing via Apple Pay or Google Pay.
  • Legal Requirements: Data may be disclosed to competent authorities as required by law.

No international data transfers outside Ukraine are performed.

5. Data Storage

  • Personal data is stored for the duration of the user's use of the Application.
  • Upon account deletion, all data, except for violation history, account suspension status, and email address, is deleted immediately.
  • Violation data is retained as necessary for security and legal compliance.
  • Data is stored in the Supabase database, which complies with industry security standards.

6. Data Protection

The Developer implements security measures, including:

  • Encryption of data during transmission and storage.
  • Use of secure Supabase servers.
  • Restricted access to data.

The Developer maintains up-to-date security standards but cannot guarantee absolute protection against all threats.

7. User Rights

Users have the following rights under applicable law:

  • Access to their data and information about its processing.
  • Correction of inaccurate data.
  • Deletion of data (except for data required to be retained by law).
  • Restriction of data processing.
  • Data portability (where technically feasible).
  • Opt-out from Mixpanel analytics via Application settings.
  • Filing a complaint with a supervisory authority (e.g., the Ukrainian Parliament Commissioner for Human Rights, EU, or California authorities).

8. Age Restrictions

The Application is intended for individuals aged 16 and older. Users under 16 must obtain consent from parents or legal guardians. The Developer does not knowingly collect data from minors without such consent.

9. Changes to the Policy

The Developer may update this Policy, notifying users 30 days in advance via the Application or email. Continued use of the Application after changes take effect constitutes consent to the updated Policy.

11. Applicable Law

This Policy is governed by Ukrainian law. For users in the EU and California, mandatory GDPR and CCPA provisions apply. Disputes are resolved as stipulated in the User Agreement.
